This document defines the nature of the ScopeCheck service and the limits of its use. It forms an integral part of the Terms of Service for the ScopeCheck Service and is interpreted together with them. By ordering an audit, you acknowledge the following.
1. What the audit is
1.1 ScopeCheck is a professional assessment of a client brief (specification, tender) before software development. The output is a Report with a score (0–100), a verdict, the main risks and ambiguities, and a recommended next step (sharpen the quote, refine the scope, or decline the project).
1.2 The audit is an aid to the Customer's decision-making; it does not take over the business decision for them.
2. The audit is not a project quote and not legal advice
2.1 The audit is not a project quote, a project cost calculation, or a binding estimate of effort or price.
2.2 The audit is not legal advice, nor an assessment of contractual or legal questions, and does not replace consultation with a lawyer or other professional.
3. The assessment is based solely on the brief provided
3.1 The Report is based solely on the content of the brief the Customer provided. Its quality and completeness depend on the quality and completeness of the brief. An incomplete, unclear or inaccurate brief leads to a limited or distorted assessment.
3.2 The score and verdict are of an advisory and informational nature. They do not guarantee that a project will (or will not) be successful, nor that all risks, ambiguities or gaps have been identified. The audit is performed with professional care, but not as an exhaustive review.
4. Customer responsibility
4.1 The Customer is fully responsible for:
- the decision on how to use the Report (quote, refine scope, decline),
- their own due diligence, pricing and contractual setup of the project,
- the legal basis for providing the brief for the audit and for the brief containing no sensitive data,
- verifying legal and contractual questions with a qualified professional.
5. No warranties and limitation of liability
5.1 The Service is provided with professional care, but without any warranty of completeness, freedom from errors, or the achievement of a particular business outcome.
5.2 To the maximum extent permitted by law, the Provider is not liable for business decisions made on the basis of the Report, nor for lost profit or indirect and consequential damage. The scope and limitation of liability are further governed by the Terms of Service for the ScopeCheck Service. The limitations do not apply to the extent that the law does not permit them to be excluded or limited (in particular for damage caused intentionally or by gross negligence, and in relation to consumers to the extent of their statutory rights).
